Under and by virtue of the power of sale contained in a Purchase Money Mortgage dated May 12, 2006, by and between Carnelious Jones and Gwendolyn Jones AKA Gwendolyn Wynn, his wife, and Melvin Brown,  recorded among the Land Records of Baltimore City, Maryland, in Liber 07965, folio 0168, which was given to secure a loan on the real property described therein, and default having occurred under the terms and conditions thereof, the undersigned Mortgagee will sell at public auction at

the main entrance of the Courthouse-East for the Circuit Court for Baltimore City, 111 North Calvert St. Baltimore, MD 21202,

All that lot of ground situate in Ward 9, Baltimore City, State of Maryland, and described as follows:
 

Beginning for the same on the northwest side of Cecil Avenue at the distance of 43.60 feet northeasterly from the corner formed by the intersection of the northwest side of Cecil Avenue and the northeast side of Exeter Hall Avenue which place of beginning is at a point in line with the center line of the partition wall between the house erected on the lot now being described and the house erected on the lot adjoining thereto on the southwest and running thence N. 38 degrees 10' E. binding on the northwest side of Cecil Avenue 14.32 feet to a point in line with the center line of the partition wall between the house erected on the lot now being described and the house erected on the lot now being described and the house erected on the lot adjoining thereto on the northeast; running thence N. 51 degrees 50' W. 100.00 feet through and along the center line of said last mentioned partition wall to the end thereof and continuing the same course to the southeast side of an alley 15 feet wide there situate; thence running S. 38 degrees 10' W. binding on the northeast side of said alley with the use thereof in common with others 14.32 feet to meet a line drawn northwesterly from the place of beginning through and along the center line of the partition wall first above mentioned in this description; thence running S. 51 degrees 50 E. reversing said line so drawn and binding thereon 100.00 feet to the place of beginning. The improvements thereon being known as no. 2530 Cecil Avenue.

 

Being the same lot of ground described in a Deed of Assignment dated June 25, 2004 and recorded among the Land Records of Baltimore City in Liber 5698 folio 30, which was granted and assigned by Virgie Lee Fogg unto Gwendolyn Wynn (aka Gwendolyn Jones), one of the Borrowers herein, for all the residue of the term of years yet to come and unexpired therein with the benefit of renewal forever; subject to the payment of the annual rent of $85.00 payable half-yearly on the 1st days of March and September in each and every year.

 

Terms of Sale: A deposit of Five Thousand Dollars ($5,000.00) will be required of the purchaser in the form of certified or cashier’s check on the day of sale.  The Mortgagee of the Purchase Money Mortgage, if a bidder, shall not be required to make a deposit.  Interest at the rate of ten percent (10%) per annum shall be paid on the unpaid purchase price from the date of sale to the date of settlement if the property is purchased by someone other than the Mortgagee.  The balance of the purchase price shall be paid in cash within fifteen (15) days of final ratification of the sale by the Circuit Court for Baltimore City,  time being of the essence. If compliance with the terms of sale does not take place within fifteen (15) days after final ratification, the deposit shall be forfeited and the property resold at the risk and expense of the defaulting purchaser. All past due property taxes shall be paid by the purchasers.  All other public charges or assessments, including water and sewer charges, ground rent, condominium/HOA dues, whether incurred prior to or after the sale, shall be paid by the purchaser.  The costs of all recordation and transfer taxes, any agricultural use or transfer tax, and any and all other settlement costs incident to the recording of the deed to the purchaser shall be borne by the purchaser.
 

The Mortgagee reserves the right to reject any and all bids in his sole and absolute discretion and to extend the settlement date.  Purchaser assumes the risk of loss to the property immediately after sale and shall be solely responsible for obtaining possession of the property.
 

If for any reason the Mortgagee is unable to convey title, the purchaser’s sole remedy at law and equity shall be limited to the refund of the deposit to the purchaser.  Upon refund of the deposit, the sale shall be null and void and have no further force and effect, and the purchaser shall have no claim against the Mortgagee, Mortgagee's Agents, or Auctioneers.
