The Southeast Quarter (SE?) of Section Four (4), Township Twenty-Eight North (28N), Range Thirteen (13) W.I.M., Woods County, Oklahoma.

Land Description

This quarter section has a wheat base of 119.8 acres, with a yield of 31 bushel. There is currently 140.8 acres of cropland of which there is 70 acres of alfalfa and 70.8 acres in cultivation.

Minerals

Eighty acres of minerals will be auctioned after surface sells. Minerals are currently leased until December 19, 2008, with an additional 2 year option at $51.00 per acre, 3/16 royalty. The remaining 80 acres of minerals will revert back to surface owner in the fall of 2013, as long as there is no production.

Terms of Minerals

10% down upon signing of contract, to be held in escrow at Community Bank, Alva, Oklahoma, and balance is due upon approval of mineral deed. (Mineral Deed Only)

Possession

Buyer will be given possession of land that is planted to alfalfa upon closing. The cultivated land that will be planted to wheat will be given possession after harvest of 2007, or July 1, 2007, whichever is first. Possession of barns and all out buildings will be given after December 31, 2006.

Taxes

Prorated to day of closing. 2005 taxes were $675.46.
