Auctioneer - Joseph B. Hise
1. This is an "ABSOLUTE AUCTION" it will sell to the highest qualified buyer irregardless of price.
2. All bidders are required to register and give full identification prior to the beginning of the auction.
3. The property will be offered in its AS IS condition with any and all faults. The buyer acknowledges that he/she has inspected the property and accepts it in its AS IS condition. The Buyer understands that there are no warranties either expressed, or implied and is solely relying upon their own judgment.
4. The Seller shall convey the real estate by good, sufficient and recordable warranty deed, or similar instrument with warranty covenants, with merchantable title to the property, free and clear of all liens and encumbrances.
5. The successful bidder must make a $7,500 down payment of earnest money on auction day. Payment may be made in cash, cashiers check, or approved personal or corporate check.
6. Earnest money deposit is non-refundable, and will be returned to the purchaser at time of closing. Buyer agrees to close and the balance of the purchase price shall be due and payable within 30 days of the date of the auction.
7. All announcements made on auction day may supersede any published or previously announced terms and conditions.
8. Bidder is advised that Auctioneer Joseph B. Hise and Broker, Realty Done Right LLC are agents of the sellers.
9. A Buyers premium of 10% will be added to the final bid. It is agreed by both Seller and Purchaser that payment of a Buyer's Premium, in no way affects the Agency Relation between the Purchaser and Brokerage or Auctioneer.
10. Bidder agrees to the above terms and conditions of the auction prior to receiving a bid card.
11. The highest acceptable Bidder and the Seller agree to acknowledge and sign all necessary documents pertaining to the Auction immediately after the Auction, including the Agency Disclosure Statement, Terms and Conditions and the Purchase Agreement.
